Get Wet The Adventure Company Limited Booking Terms and Conditions

 

1. General Issues

1.1. These Booking Terms and Conditions apply to the booking of any of the Get Wet The Adventure Company Limited activities (the Activities) at the location set out in Get Wet The Adventure Company Limited's booking confirmation. 

1.2. These Booking Terms and Conditions contain important information concerning participation by you and members of your party and, accordingly, you acknowledge and agree that you shall ensure that all members of your party are aware of and accept

these Booking Terms and Conditions.

1.3. No variation to these Booking Terms and Conditions shall be binding unless agreed in writing by Get Wet The Adventure Company Limited.

1.4. Any typographical clerical or other error or omission in any booking confirmation or other documentation issued by Get Wet The Adventure Company Limited (including any electronic documentation) shall be subject to correction without any liability on the part of Get Wet The Adventure Company Limited.

1.5. Get Wet The Adventure Company Limited reserves the right to make changes to the Activities whether to conform with any applicable safety or other statutory requirements or otherwise

2. Booking Confirmation

2.1. No booking shall be deemed to have been accepted unless accepted in writing by Get Wet The Adventure Company Limited (which shall include Get Wet The Adventure Company Limited's email confirmation of booking).

2.2. These Booking Terms and Conditions incorporate Get Wet The Adventure Company Limited's Privacy Policy, and Risk Acknowledgement and Disclaimer. You and each member of your party will be required to sign the Risk Acknowledgement and Disclaimer before being allowed to undertake the Activities.

2.3. You must advise Get Wet The Adventure Company Limited as soon as possible of any mistake in Get Wet The Adventure Company Limited's booking confirmation. Get Wet The Adventure Company Limited shall use its reasonable endeavours to ensure that you and your party's participation commences at the time booked and it shall be the responsibility of each participant to ensure that they arrive in sufficient time. Late arrivals may not be permitted to undertake the Activities and no refunds or compensation will be payable in such circumstances.

3. Safety

3.1. Participation in "the Activities" of Get Wet The Adventure Company Limited are not without risk. All participants will receive detailed safety training from an instructor.

3.2. Get Wet The Adventure Company Limited reserves the right to refuse admittance to the Activities or to remove a participant from the Activities should it deem it necessary to do so. This includes a participant who does not comply with the safety rules and advice and the safety system or who is deemed to be under the influence of alcohol or drugs.  

3.3. All participants will receive a briefing from a qualified instructor prior to their chosen activity. Participating adults must sign a Risk Acknowledgement and Disclaimer stating that he or she will accept responsibility for the safety of him or herself and for supervision of children in his or her care. Adults participating on the High Ropes Course may supervise a maximum of 5 young people (2 can be between 10 and 16) and (3 can be between 16 and 18).

3.4. All participants for the activities must be reasonably fit and healthy.

3.4.1To participate on the high ropes course height restricitions do apply. Participants must be a minimum of 4ft 7inches/1m 40cm, at least 10 years old and must weigh less than 20.5 stones/130kg. Anyone who does not meet these requirements will not be allowed to undertake the high ropes course.

3.4.2.To participate in any paintballing activities participants must be twelve or over and must have an adult (18+) present prior to the session to read and sign a Risk Acknowledgement and Disclaimer on there behalf.

3.4.3.It is your responsibility to ensure that all members of your party meet these requirements.  

3.5. All participants are required to wear a safety equipment provided by Get Wet The Adventure Company Limited safety equipment must be fitted by or checked by an instructor.

3.6. The Activities are physically demanding and require a degree of agility, strength and stamina. If participants have medical concerns they are advised to consult their doctor in advance. Participants will be required to certify that they do not suffer from any medical condition which would make it more likely that they would be involved in any incident which could result in injury to themselves or others. Due to the physical nature of the Activities Get Wet The Adventure Company Limited recommends that pregnant women should not take part.

3.7. All participants are required to act responsibly and courteously at all times and to respect other participants. Get Wet The Adventure Company Limited shall be entitled to prevent any person from undertaking or completing the Activities in the event it deems the behaviour of any participant unsuitable.

3.8. Participants must be dressed appropriately (see clause 4) and Get Wet The Adventure Company Limited reserves the right to refuse admittance to the Activities to any participant who is not appropriately dressed.

3.9. The Activities will remain open in most weather conditions (but not in circumstances of gales, lightning, heavy ice or snow).

3.10. No refunds or compensation will be payable by Get Wet The Adventure Company Limited in the event that any participant is not permitted to, or decides not to, undertake or complete the Activities for the reasons set out in this clause.

4. Clothing

4.1. It shall be the responsibility of all participants to ensure that they are dressed appropriately and Get Wet The Adventure Company Limited advises participants to

wear clothing appropriate for the weather conditions and which they do not mind getting damaged. In particular the following restrictions shall apply:

4.1.1. participants may not undertake the Activities in open-toed or slip-off shoes (ankle-supporting boots are best)

4.1.2. long hair must be tied back 

4.1.3. waists must be covered and piercings removed or taped over for comfort

4.2. Get Wet The Adventure Company Limited will not be responsible for any damage to or loss of clothing or other personal items of persons resulting from participation in the Activities.

5. Cancellations  

5.1. Cancellations before 15 days of session: Clients are entitled to change the time or date of their session to one more suitable or a refund (Refunds will be paid in the same fashion as payment was received).

5.2. Cancellations at or after 15 days before day of session: Clients are not entitled to make alterations to their booking or receive any refund.

5.3. Get Wet The Adventure Company Limited shall be entitled to cancel your booking at any time. In the event that Get Wet The Adventure Company Limited decides to cancel your booking it shall use its reasonable endeavours to notify you as soon as possible. You shall be entitled to a full refund in the event of cancellation under this clause but no other compensation shall be payable.

5.4. In the event that it proves necessary to close the Activities for reasons beyond the control of Get Wet The Adventure Company Limited and in circumstances where

your party has commenced participation in the Activities, you shall not be entitled to any refund (in part or in whole). In such circumstances Get Wet The Adventure Company Limited may, but shall not be obliged to, offer alternative dates or times at reduced rates.

6. Group Bookings via Account Application Form

6.1   In the event your booking is made via Get Wet The Adventure Company Limited's Account Application Form these Booking Terms and Conditions shall be subject to any special terms set out in the Account Application Form. In the event of any conflict between the terms herein and the terms set out in the Account Application Form the latter shall prevail.

7. Price and Payment  

7.1. Subject to any terms agreed in writing between Get Wet The Adventure Company Limited and you, our charges shall be calculated at our current rates and payment in full shall be due at the time of booking. Payment may be made by debit or credit card either on line or by contacting the booking line: 07909768950

8. Refunds and Amendments

8.1. Payments made by debit or credit card will be refunded to the same card or, if the card has subsequently expired, by cheque. Payments made by Gift Voucher will be refunded by the issuing of a replacement Gift Voucher to the same value.

8.2. Where multiple forms of payment are used, Get Wet The Adventure Company Limited reserves the right to refund any monies due on a refund or amendment by credit or cheque.

9. Liabilities

9.1. Except as otherwise provided in these Booking Terms and Conditions Get Wet The Adventure Company Limited shall not be responsible for the loss, or damage, of or to any property or to any person arising from the booking of or participation in the Activities.

9.2. Parking facilities are available at the site, and any vehicles are left at the owners' risk and subject to any conditions.

9.3. Except as otherwise provided in these Booking Terms and Conditions any liability of Get Wet The Adventure Company Limited shall be limited to the refund of any

charges paid to Get Wet The Adventure Company Limited.  

9.4. Nothing contained in these Booking Terms and Conditions is intended to nor shall limit the liability of Get Wet The Adventure Company Limited in respect of death or personal injury caused by the negligence of Get Wet The Adventure Company Limited or of its employees, agents or contractors.

10. Miscellaneous

10.1. If any of these terms are determined to be illegal invalid or otherwise unenforceable it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and continue to be binding and enforceable.

10.2. Nothing above shall confer on any third party any benefit or the right to enforce any of these Booking Terms and Conditions.

10.3. These Booking Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales and Get Wet The Adventure Company Limited and you submit to the exclusive jurisdiction of the courts of England and Wales.

1.1 Access to and use of this website shall be subject to the Terms of Use set out below. Bookings made on this website are subject to our Booking Terms & Conditions. Get Wet The Adventure Company Limited shall be entitled to amend these Terms of Use at its discretion. You may access and use the website only in accordance with these Terms of Use.

1.2 You shall be entitled to download content from this website for personal and non-commercial purposes only. You shall not otherwise copy, reproduce, re-distribute, republish, download, post, broadcast, transmit or otherwise use any of the website content other than in accordance with these Terms of Use or with the prior written permission of Get Wet The Adventure Company Limited.
